Tired of Being a Landlord? How to Sell a Rental in California

By Bilal Salimi, Broker, DRE# 01480904 · NMLS# 300923 · Updated October 28, 2026

You can sell a California rental with the tenant in place, after a negotiated move-out, or after a lawful owner move-in. Selling is not by itself a just cause to end a tenancy under California's Tenant Protection Act, so the buyer usually takes the home subject to the lease. To defer capital gains tax, you can use a 1031 exchange into other investment property.

Your options

Sell with the tenant in place

Best when: The rent is solid and the buyer is likely an investor.

Pros
  • No vacancy or lost rent
  • Investors value a proven rent roll
  • Simplest legally
Watch out for
  • Owner-occupant buyers, often the largest pool, may pass
  • Showings require written notice; 24 hours is presumed reasonable

Negotiated move-out ("cash for keys")

Best when: The home would sell for meaningfully more vacant, and the tenant is open to moving.

Pros
  • Opens the sale to owner-occupant buyers
  • Allows repairs and staging
Watch out for
  • Voluntary only, and local rules apply; for example, Oakland lets tenants cancel a move-out agreement within 25 days
  • The cost must be weighed against the price difference

Owner or family move-in, then decide

Best when: You or a close family member genuinely plan to live there.

Pros
  • A recognized no-fault just cause under state law
  • Can restore the home-sale tax exclusion if you live there long enough
Watch out for
  • The person must move in within 90 days and stay at least 12 months
  • Relocation assistance is owed, at least one month's rent under state law

1031 exchange into another investment

Best when: You want out of this property but want to stay invested in real estate.

Pros
  • Defers capital gains and depreciation recapture tax
  • Can move into less management-heavy property
Watch out for
  • Replacement property must be identified within 45 days and acquired within 180 days
  • Requires a qualified intermediary before closing

Keep renting, with a better setup

Best when: The numbers still work; the management is the problem.

Pros
  • Keeps appreciation and income
  • A property manager can take over day-to-day work
Watch out for
  • Rent increases are limited by state law (and in some cities, local law)
  • Management fees reduce cash flow

How I help

I help landlords decide between selling with the tenant, selling vacant, exchanging, or keeping the property, with a net-proceeds and after-tax comparison your CPA can check. I market tenant-occupied homes to the right investors, coordinate showings within the notice rules, and work with your qualified intermediary on 1031 timing. SI MTG can also finance your replacement property.

Frequently asked questions

Can I sell my rental property with a tenant in it in California?

Yes. The lease stays in effect and the buyer takes the property subject to it. You must give the tenant written notice before showings; 24 hours is presumed reasonable.

Is selling the house a reason to evict a tenant in California?

No. Under the Tenant Protection Act, selling is not by itself a just cause. A no-fault cause such as an owner or family move-in, or withdrawing the unit from the rental market, may apply, with relocation assistance.

How much notice do I give a tenant for showings?

Reasonable written notice of the date, time and purpose; 24 hours is presumed reasonable. If you notified the tenant in writing within the past 120 days that the home is for sale, you can give oral notice for showings.

How does a 1031 exchange work?

You sell investment real estate and reinvest the proceeds in other investment real estate through a qualified intermediary. You must identify the replacement within 45 days and close within 180 days to defer the tax.

What is depreciation recapture?

When you sell a rental, the depreciation you claimed over the years is taxed at up to 25%. A 1031 exchange can defer it.
